1) Terms of Service

Important notice: These Terms form a legally binding agreement between you and the operator of mystoragesystem.com (“we,” “us,” or “our”). By creating an account, accessing, or using the Service, you accept these Terms. If you do not agree, do not use the Service.

1.1 The Service

The Service is a software-as-a-service platform for warehouse accounting and equipment planning (the “Service”). We may update or discontinue any feature at any time with or without notice, to the maximum extent permitted by law.

1.2 Eligibility & Accounts

  • You must be at least 18 and have authority to bind your organization.
  • You are responsible for all activity under your account and for keeping credentials secure.
  • We may suspend or terminate accounts for any reason, including suspected misuse or non-payment.

1.3 Acceptable Use

  • Do not use the Service for unlawful, harmful, or high-risk purposes (including but not limited to life-support, emergency or safety-critical systems, or real-time navigation).
  • Do not attempt to interfere with security, access non-public areas, or reverse engineer.
  • You are solely responsible for Your Data and for complying with all laws that apply to your business.

1.4 Subscriptions, Fees, & Taxes

If your plan requires payment, you agree to pay all fees and applicable taxes. Fees are non-refundable except where required by law. We may change prices prospectively by posting an updated price or notifying you in-product or by email.

1.5 Your Data

Your Data” means any content, records, files, or configurations you submit to the Service. You retain all rights to Your Data. You grant us a worldwide, non-exclusive license to host, store, process, transmit, display, and back up Your Data solely to provide and maintain the Service and as otherwise permitted by these Terms and our Privacy Policy.

1.6 Third-Party Services

The Service may integrate with third-party products. We do not control and are not responsible for third-party services; your use of them is governed by their terms and policies.

The Service and any outputs are for informational purposes only and do not constitute legal, accounting, or other professional advice.

1.8 Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT OUTPUTS WILL BE ACCURATE OR MEET YOUR REQUIREMENTS.

1.9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, GOODWILL, OR DATA; BUSINESS INTERRUPTION; OR SUBSTITUTE GOODS OR SERVICES, IN EACH CASE ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED U.S. DOLLARS (US$100) IF YOU HAVE NOT PAID ANY AMOUNTS, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.

1.10 Indemnification

You will defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to Your Data, your use of the Service, or your breach of these Terms, to the maximum extent permitted by law.

1.11 Suspension & Termination

We may suspend or terminate access to all or part of the Service at any time for any reason. Upon termination, your right to use the Service ends immediately, and we may delete or disable access to Your Data in our possession after a commercially reasonable period, except where the law requires retention. Sections intended to survive (including, without limitation, ownership, disclaimers, limitations of liability, indemnities, and dispute terms) will survive.

1.12 Export & Sanctions

You must comply with U.S. export control and sanctions laws and may not use the Service if you are located in, or are a resident or national of, any embargoed country or are on any restricted party list.

1.13 Governing Law; Arbitration; Class Waiver

These Terms and any disputes arising out of or relating to them or the Service are governed by the laws of the State of Delaware, without regard to conflicts of law rules.

Binding Arbitration: Any dispute will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules. The arbitration will take place in Wilmington, Delaware, in English, before a single arbitrator. You and we waive any right to a jury trial.

Class Action Waiver: Disputes must be brought in the parties’ individual capacities, not as plaintiffs or class members in any class or representative action.

You may seek relief in small-claims court if your claim qualifies. Either party may seek injunctive relief in court to protect intellectual property or confidential information.

1.14 Modifications

We may update these Terms at any time by posting a revised version on the Site or in the Service. Your continued use after changes become effective constitutes acceptance.

1.15 Entire Agreement

These Terms, together with any order form or plan details you accept in the Service, constitute the entire agreement and supersede all prior or contemporaneous agreements relating to the subject matter. If any provision is unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver.

2) Privacy Policy

This Privacy Policy explains how we handle personal information when you use mystoragesystem.com and related services (collectively, the “Service”). We aim to be concise and transparent while reserving broad operational flexibility, subject to applicable law.

2.1 Information We Collect

  • Account & Contact Data: name, email, password, company details, role.
  • Transactional & Billing Data: plan, invoices, limited payment information processed by our payment processor (we do not store full card details).
  • Usage & Device Data: log files, IP address, identifiers, app events, device and browser information, and cookies or similar technologies.
  • Customer Content (“Your Data”): warehouse records, inventory, equipment plans, files, and configurations you upload or create.
  • Support Data: messages, tickets, and feedback you send us.

2.2 How We Use Information

  • Provide, operate, secure, troubleshoot, and improve the Service.
  • Process payments, prevent fraud/abuse, and enforce policies.
  • Communicate with you about updates, security alerts, and administrative messages.
